Terms of Service

Effective July 17, 2026

These Terms of Service ("Terms") are an agreement between you and Sunset Capital LLC ("Sunset," "we," "us," or "our") governing your use of Index. By creating an account or using Index, you agree to these Terms.

Eligibility and accounts

You must be at least 13 years old and legally able to enter this agreement. You are responsible for your account activity, for providing accurate account information, and for protecting your sign-in credentials. Tell us through the in-app Feedback tab if you believe your account has been compromised.

The Index service

Index lets you save content and use software or artificial-intelligence systems to organize and discuss it. Features may change, especially during early access. We may add limits, modify features, or suspend parts of the service to maintain reliability, security, or legal compliance.

Your content

You retain ownership of content you submit. You give Sunset a limited, worldwide, non-exclusive license to host, reproduce, transform, transmit, and display that content only as reasonably necessary to operate, secure, and improve Index and to provide features you request. You represent that you have the rights needed to submit the content and permit this use.

Acceptable use

You may not use Index to violate law or another person's rights; distribute malware; bypass security or access controls; interfere with the service; scrape or probe the service without permission; impersonate others; or store or distribute illegal, infringing, exploitative, or harmful material. You may not use generated output to make automated high-impact decisions about a person without appropriate human review and legal compliance.

AI output

You are responsible for evaluating output before using or sharing it. Similar output may be generated for other users. We do not claim ownership of output to the extent ownership can legally arise, but your use of it remains subject to these Terms and applicable law.

Third-party services

Index interoperates with third-party platforms and providers. We do not control those services and are not responsible for their availability, content, or independent practices. Your use of a third-party service may be governed by separate terms.

Termination and deletion

You may stop using Index at any time and delete your account in the app. We may suspend or terminate access if you materially violate these Terms, create risk for users or the service, or if required by law. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and dispute provisions.

Disclaimers

To the fullest extent permitted by law, Index is provided "as is" and "as available." Sunset disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not guarantee that content will never be lost; keep independent copies of critical information.

Limitation of liability

To the fullest extent permitted by law, Sunset and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities. Our aggregate liability relating to Index will not exceed the greater of $100 or the amount you paid us for Index during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Changes

We may update these Terms. If a change is material, we will provide notice as required by law. Continued use after the effective date of updated Terms means you accept them.

General

These Terms and the Privacy Policy are the entire agreement about Index. If one provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, or transfer of the service. Applicable law determines any mandatory governing law, venue, or consumer rights.
